NIS2 deadlines: the dates for companies in Germany and the EU

In Germany, NIS2 has applied since 6 December 2025 through the BSI Act (BSIG). The duties run from that day. You must register at the latest three months after your company comes into scope; for companies in scope since December 2025 that was 6 March 2026. You report a significant incident within 24 hours.

The deadlines for your company

These deadlines are in the BSIG. Some run from a date, some from an event.

6 December 2025

The new BSIG enters into force. From this day the duties apply to companies in scope.

BGBl. 2025 I no. 301

3 months after coming into scope

§ 33(1) BSIG

2 weeks after a change

Update changed registration details in the BSI portal, such as a new address.

§ 33(5) BSIG

§ 32(1) BSIG

Regularly

§ 38(3) BSIG

The BSI can ask essential entities for evidence. For approved hospitals, from 6 December 2030 at the earliest.

Every 3 years

Operators of critical facilities prove their measures to the BSI, the first time on a date the BSI sets.

§ 39(1) BSIG

The EU dates

The directive is addressed to the member states. Its dates reach companies only through their country's law.

16 January 2023

Directive (EU) 2022/2555 enters into force.

Art. 45 NIS 2

17 October 2024

By this date all member states should have transposed the directive into their law. Many, Germany among them, were later.

Art. 41(1) NIS 2

17 April 2025

The member states draw up a list of essential and important entities.

Art. 3(3) NIS 2

17 October 2027

The Commission reviews the directive, then every 36 months.

Art. 40 NIS 2

How far each EU country has got

What this means for a company with 50 to 150 employees

Most deadlines do not run from a date but from an event: an incident, a change, the day your company comes into scope. What matters, then, is that someone knows what to do when it happens.

If your company only comes into scope later, for example because it grows to 50 employees, the three months for registration start on that day.

§ 33(1) BSIG

An example

A made-up company: a food manufacturer with 120 employees. It has been an important entity since 6 December 2025.

On 2 March 2026 it registers in the BSI portal, four days before the deadline.

On 10 June the contact person leaves the company. By 24 June it enters the new contact person in the portal.

Monday, 8 a.m.: order intake fails after an attack. The early warning must reach the BSI by Tuesday, 8 a.m., the incident notification by Thursday, 8 a.m.

The managing director attended training in May 2026. On the explanatory memorandum's reading, the next one is due by 2029 at the latest.

How the walkthrough does this

The walkthrough at nisd2.eu records which duties remain after implementation and which deadlines belong to them.

After approval, one page shows what stays with you: what to do in an incident, with the deadlines, and what recurs.

Each duty is listed there with its legal basis, for example § 32(1) BSIG for the reporting deadlines.

The registration step records the date of registration.

The training step records the latest training of each member of management.

Common questions

When does NIS2 apply in Germany?

Since 6 December 2025. The new BSI Act entered into force on that day. Since then the duties apply to every company that is an essential or important entity.

Is there a transition period?

Not for the measures, reporting or registration. Only some supervisory dates come later: the BSI can ask essential entities for evidence from 6 December 2028 at the earliest (§ 61(3) BSIG).

We missed the registration deadline. What now?

Register now. The duty remains even though the deadline has passed.

How long do I have to report an incident?

The early warning must reach the BSI at the latest 24 hours after you became aware of a significant incident, the incident notification at the latest after 72 hours. The final report follows one month after the notification (§ 32(1) BSIG).

Austria: NISG 2026 in force, the Bundesamt fuer Cybersicherheit starts work and registration opens in NIS2 Services

The NISG 2026 (BGBl. I Nr. 94/2025), Austria's NIS 2 transposition, entered into force on 1 October 2026, and the Interior Ministry confirmed the same day that the new Bundesamt fuer Cybersicherheit has taken up work under its director Markus Kasinger. Essential and important entities and providers of domain name registration services register through the NIS2 Services application in the Unternehmensserviceportal within three months of entry into force. The authority gives 1 January 2027 as the nominal date and 4 January 2027 as the latest date, because section 33(2) AVG moves the end of a deadline that falls on a public holiday or weekend to the next working day. Public administration bodies get a connection through the Portalverbund shortly after 1 October 2026. These are national deadlines under Austrian law.

Austria: NISV 2026 extends the CIR 2024/2690 measures to every entity type and sets thresholds for significant incidents

The Austrian cybersecurity authority issued the Netz- und Informationssystemsicherheits-Verordnung (NISV 2026, BGBl. II Nr. 290/2026) on 1 October 2026 under sections 32(5) and 35(3) NISG 2026; it enters into force at the end of the day of publication. Section 2 applies the requirements of Article 2 and the Annex of Implementing Regulation (EU) 2024/2690 to every type of essential and important entity listed in Annexes 1 and 2 NISG 2026, not only to the digital providers the CIR itself covers. Entities that cannot meet a requirement temporarily or because of their size must implement documented compensating measures and review them at least once a year. An incident is significant in any case if, among other criteria, it causes or can cause a direct financial loss above EUR 500,000 or 5 percent of annual turnover, whichever is lower, an outage for more than 100,000 users or 10 percent of users, whichever is lower, for more than 24 hours, or an outage across at least one Bundesland for more than 24 hours. Repeated incidents count as one significant incident if they occur at least twice in six months with the same apparent cause and together cross the loss threshold. This is binding national law.

Latvia: Cabinet Regulation No. 602 sets where essential and important entities may host their information systems

Cabinet Regulation No. 602 on information system placement and data centre security requirements, adopted on 29 September 2026 under Article 30(2) of the National Cybersecurity Law and published in Latvijas Vēstnesis on 1 October 2026, entered into force on 1 October 2026. Unless it provides otherwise, an entity places information systems only in data centres in NATO, EU or EFTA member states or in one of NATO's Indo-Pacific partner countries, and data processing has to take place in those territories. From entry into force no new class A system may be placed in a way that does not meet the regulation. Entities with existing class A placements notify them by 31 December 2026; a non-compliant existing placement may continue until 31 December 2027 if its risks are managed and a compliance plan is prepared by 31 December 2026. This is binding national law.

Sweden: regulations on security measures, management training, audits and scanning enter into force

Two regulations under the Swedish Cybersecurity Act (cybersäkerhetslagen, SFS 2025:1506), decided by the Myndigheten för civilt försvar on 15 June 2026 and published on 18 June 2026, entered into force on 1 October 2026. MCFFS 2026:11 sets out the security measures and the management training required by chapter 2, sections 3 and 4 of the act; operators that work only in digital infrastructure, digital providers, ICT service management between businesses, postal and courier services or space are bound only by its management training requirement. MCFFS 2026:12 covers security audits and security scanning under chapter 3, sections 5 to 7. The NCSC at the FRA announced the entry into force and says comprehensive guidance on the regulations will follow around the turn of the year 2026/2027. Both are binding agency regulations.

Bulgaria: Commission closes the infringement procedure for late NIS 2 transposition

Bulgaria's Ministry of Innovation and Digital Transformation reported on 1 October 2026 that it had been notified that day that the European Commission closed infringement procedure No. 2024/0257, opened for failure to notify full transposition of Directive (EU) 2022/2555. The closure follows the amendments to the Cybersecurity Act and Bulgaria's notification of full transposition to the Commission on 6 March 2026. The Commission's own infringement register could not be checked for this entry, so the source is the ministry's announcement.
